What is a medical error?

A medical error is any action or decision taken by a healthcare practitioner that leads to harm or negative consequences for the patient, including errors in diagnosis, treatment, or medical procedures.

What types of medical errors should I be aware of?

Types of medical errors include:

- Diagnostic errors (such as failure to correctly diagnose a condition).

- Treatment errors (such as administering the wrong treatment).

- Errors during surgical procedures.

- Negligence (such as delays in providing treatment).

- Unprofessional errors (such as practicing without a license).

What are the penalties for medical errors in Saudi Arabia?

Penalties may include:

- Civil liability and financial compensation for the patient.

- Disciplinary penalty with fines up to 10,000 riyals.

- Revocation of the professional license.

- Criminal penalties that may include imprisonment for up to 6 months or fines reaching 100,000 riyals.

How can I protect myself from risks related to medical errors?

To protect yourself, you can subscribe to one of the MedMal memberships, which will assist you with:

- Complying with medical practice standards.

- Accurately verifying diagnoses and treatments.

- Regularly updating your knowledge and training.

- Adhering strictly to local laws and regulations.

What should I do if I am sued for a medical error?

If you are a member of the MedMal platform, the platform will provide all necessary legal services, such as:

- Appointing a specialized lawyer in medical error cases.

- Serving as a reference for gathering documents and information related to the legal issues regarding medical errors.

- Representing you and preparing all necessary petitions and replies, among other documents.

Do medical institutions bear responsibility for medical errors?

Yes, healthcare institutions may be responsible for ensuring a safe environment and proper medical care, not just the individual practitioner. Therefore, we do not advise relying solely on the institution's lawyer where you work due to potential conflicts of interest, as they may represent both the institution and you in the same case.

How can I prove my non-responsibility for a medical error?

If you are a member of the MedMal platform, you will appoint a lawyer to represent you and prove your non-responsibility based on:

- Providing supporting evidence for proper practice.

- Submitting reports from medical committees or experts.

- Demonstrating adherence to accepted professional standards.

Is there compensation for healthcare practitioners if they are involved in a medical error?

If you are a healthcare practitioner faced with a medical error lawsuit, you may also have legal rights, especially if your non-responsibility is proven. The platform will guide you through the necessary steps.

Does Medical Malpractice Insurance Substitute for Hiring a Specialized Lawyer?

Medical malpractice insurance can provide some protection for healthcare practitioners from the financial burdens associated with lawsuits arising from medical errors; however, it does not eliminate the necessity of hiring a specialized lawyer in medical malpractice cases. Here are some points that clarify this:

  1. Insurance can cover legal costs and amounts paid as compensation, which alleviates the financial burden on the practitioner.
  2. Hiring a specialized lawyer in medical malpractice ensures that the practitioner receives accurate and appropriate legal advice, as the lawyer will have the necessary expertise to deal with the intricacies of medical cases.
  3. Appointing a dedicated lawyer helps ensure that the healthcare practitioner's rights are well protected during the legal process. For instance, a lawyer specializing in medical malpractice can handle negotiation processes regarding settlements outside of court, which can often be more effective.

Based on the above, while medical malpractice insurance provides a degree of financial security, it is crucial for healthcare practitioners to have a specialized lawyer to ensure they receive the necessary legal support in case of any issues related to medical errors.
