Available Memberships

The membership acts as an annual legal fee agreement subject to specific terms and conditions. Legal services are provided based on the type of membership selected, as follows:

Unlimited Membership (Annual):
Covers all medical malpractice and labor cases during the membership period for the membership fee only — with no additional charges. This includes full legal services such as legal consultations, representation, defense, litigation, and the preparation of all necessary documents (e.g., defense memoranda and appeal briefs) before general courts, labor courts, and the Committees for Resolution of Insurance Disputes and Violations, in matters related to medical malpractice and employment contracts of the member.
Fee: 34,500 SAR.

Fixed-Price Membership (Annual):

Provides legal services during the membership period at fixed and reasonable rates. This includes: 

  • Legal Consultations: Any consultation related to medical malpractice or employment contracts, whether at the time of subscription or during the complaint or pre-litigation stages, such as reviewing employment contracts, assisting with practitioner statements, or matters related to malpractice insurance (included in the membership).
  • Reconciliation Stage (via Taradhi Platform”):   For labor cases (initiated by either the employee or employer) or medical malpractice cases (filed by the patient), after the regional health compliance department completes its procedures and before the case is filed with the competent court through the Ministry of Justice’s “Taradhi” platform — MedMal will  appoint a lawyer to represent the member’s interests in reaching a settlement. Fee: 575 SAR.
  • Trial Stage – First Instance General Court: If the dispute is not resolved during reconciliation,  MedMal will assign a specialized lawyer to represent, defend, and prepare the necessary documents (e.g., defense memoranda) before the First Instance Court. Fee: 2,300 SAR.
  • Appeal Stage – Court of Appeal: If a ruling is issued by the first instance court and the member wishes to file an appeal or respond to one, MedMal will assign a lawyer to represent, defend, and prepare the necessary appeal brief and supporting documents. Fee: 2,300 SAR.
  • Compensation for Malicious (Frivolous) Lawsuits: If a judgment is issued in favor of the member and the patient’s or employer’s claim is deemed malicious, MedMal will appoint a lawyer to represent, defend, and file the compensation claim. Fee: 15% of the compensation amount awarded to the member.
  • Claim from the Insurance Company – First Instance Committee for Insurance Disputes: If, unfortunately, a judgment is issued against the member (our client) to compensate the patient and the insurance company refuses to cover the amount, MedMal will appoint a lawyer to represent, defend, and prepare the claim documents, including a petition to compel payment and cover legal fees. Fee: 2,300 SAR.
  • Appeal Stage – Insurance Disputes Committees (second Instant): If a judgment is issued by the First Instance Committee and is appealed, MedMal will appoint a lawyer to represent, defend, and prepare the necessary appeal documentation. Fee: 2,300 SAR.

Do medical institutions bear responsibility for medical errors?

Therefore, we do not advise relying solely on the institution's lawyer where you work due to potential conflicts of interest, as they may represent both the institution and you in the same case.

How can I prove my non-responsibility for a medical error?

If you are a member of the MedMal platform, you will appoint a lawyer to represent you and prove your non-responsibility based on:

- Providing supporting evidence for proper practice.

- Submitting reports from medical committees or experts.

- Demonstrating adherence to accepted professional standards.

Is there compensation for healthcare practitioners if they are involved in a medical error?

If you are a healthcare practitioner faced with a medical error lawsuit, you may also have legal rights, especially if your non-responsibility is proven. The platform will guide you through the necessary steps.

Does Medical Malpractice Insurance Substitute for Hiring a Specialized Lawyer?

Medical malpractice insurance can provide some protection for healthcare practitioners from the financial burdens associated with lawsuits arising from medical errors; however, it does not eliminate the necessity of hiring a specialized lawyer in medical malpractice cases.
